You are moving. Your family is not.
Several European systems presume you are still tax resident if your spouse and minor children live there. Spain states it explicitly in Article 9 of the IRPF Law. It is a presumption, not a rule — it can be rebutted with evidence — but it starts the analysis against you, and rebutting it after the fact is far harder than planning around it.
Who this affects
Anyone relocating ahead of their family, or without them. Staged moves where one partner goes first are extremely common and are precisely the shape this presumption is written for.
Why it matters
It is the one tie that cannot be restructured. You can move a company, close an account, sell a flat. You cannot reorganise where your children go to school in order to improve a tax position, and nobody should. So this is the constraint that shapes the timeline rather than one you optimise around — which is why it belongs at the start of the planning, not the end.
What they actually look at
- Where your spouse or civil partner is habitually resident
- Where minor children are enrolled in school
- Whether the separation is genuine and durable or a paper arrangement
- Whether the family later joined you, and how quickly
How it is resolved
- Sequencing the move so the family follows within a defined and documented window
- Where the separation is genuine and permanent, evidencing it properly rather than leaving it ambiguous
- Accepting, in some cases, that the exit should wait — a delayed clean exit beats a contested one
- Never constructing a fictional separation, which is the version that turns a tax question into a fraud question
The common mistake
Assuming that because you personally spend under 183 days there, the family question does not arise. It arises first.
When the door closes
This one shapes the calendar rather than having one. It should be settled before a departure date is chosen, not after.

Which profiles this complicates most
- Tax residency for freelancers and autónomos — “I invoice clients directly, mostly back home”
- Tax residency for remote employees — “I am on payroll at a company in another country”
